Can Dell Hold its ‘Cloud Computing’ Trademark?

Dell’s newly-acquired trademark for the term “cloud computing” may have all the durability of a glass hammer, meaning it will shatter the first time they try to use it. The law is not exactly on the company’s side in this argument.

For a trademark to stick, say legal experts, it has to have a unique source of origin. It must mean when you hear this term, you think of that company. PowerEdge, for example, is a Dell trademark because that is its line of servers, just as ProLiant is a HP trademark and Windows is a Microsoft trademark.

The problem for a “cloud computing” trademark is that the term has become generic, widely adopted by the industry at large in the 18 months since Dell (NASDAQ: DELL) first applied for the trademark.

With its open source and proprietary rivals proliferating and shoring up their positions, the Linux-based LiMo Foundation is pulling out all the stops in its bid to establish itself as the preeminent mobile platform.

LiMo, an alliance of major handset vendors and carriers developing a Linux-based smartphone operating system, this week revealed a number of new handsets boasting sought-after features. Today at the LinuxWorld conference, its members unveiled the Motorola EM 30.

The new device, sporting GPS, advanced music features and other enhancements, joined seven additional handsets announced on Monday — including Motorola’s (NYSE: MOT) Motozine zN5, four NEC handsets and two Panasonic Mobile Communications devices.

Top Web companies have reached a tentative agreement with human-rights organizations and other groups on a voluntary code of conduct governing Internet operations in countries where Internet freedom is curtailed. Sen. Dick Durbin (D-Ill.), who chairs the Subcommittee on Human Rights and the Law, praised Microsoft, Yahoo and Google for the letters each submitted saying that they have agreed in principle on the global code of conduct to promote human rights and Internet freedom. “This code of conduct would be one important step toward our shared goals of promoting freedom of expression and protecting the privacy of Internet users around the world,” Durbin said in a statement. Friendster Names Googler as New CEO

Friendster has named Google’s regional managing director of South Asia, Richard Kimber, as its new CEO. It has also raised $20 million in funding.

Despite the waning of its popularity in the United States, Friendster is the #1 social network in Asia, and the 9th largest website in the world.

“Friendster is growing at an enormous rate in Asia Pacific and is clearly leading the competition. I believe this is partly because the Internet is transforming the lives of everyone, and it will probably become one of the greatest liberators of our time,” said Kimber. “Utilizing the Internet to connect to your friends is one of its greatest benefits, and is changing the way relationships work globally.

IBM, Linux and the Microsoft-Free PC

IBM is expanding its Linux solution set today with a new initiative together with Red Hat, Novell and Ubuntu for Microsoft-free PCs.

After 10 years of supporting Linux, IBM (NYSE: IBM) continues to challenge Microsoft on multiple fronts and aims to push Linux even further into the enterprise. While IBM has competed and partnered with Microsoft over the last two decades, the Microsoft-free PC effort is perhaps its most direct assault yet.

“The idea of Microsoft-free personal computing has been in the air for a while,” Inna Kuznetsova, director of Linux at IBM, told InternetNews.com.

U.S. technology giants Microsoft, Google and Yahoo, in talks with other Internet companies and human-rights groups, have reached an agreement on a voluntary code of conduct for activities in China and other restrictive countries, the Wall Street Journal reported on Tuesday. In separate letters sent to Sens. Richard Durbin (D-Ill.) and Tom Coburn (R-Okla.), the companies said the code’s details were being worked out, the paper reported. The two lawmakers had asked for an update out of concern that without such a code, Internet companies could be pressured by China’s government to provide information about Internet users who are in China for the Olympics, the paper said. AT&T Sets Sights on Cloud Computing
U.S. phone company AT&T (NYSE: T) has joined the likes of Google (NASDAQ: GOOG), Microsoft (NASDAQ: MSFT) and IBM (NYSE: IBM) in delivering Web-based business services from its datacenters rather than having customers run the services themselves. The new service, which is a part of AT&T’s $1 billion planned global network investment in 2008, will span the United States, Europe and Asia. AT&T’s latest move reflects the company’s efforts to capitalize on the shift by customers away from in-house computer systems to “cloud computing” — a less expensive alternative. One of AT&T’s first customers is the U.S. Olympic Committee, whose official Web site is powered by AT&T’s service, the company said in a release. EMC has once again retooled its Clariion midrange storage system — but this time with a twist. In addition to bulking up capacity, the CX4 series includes built-in advanced features such as virtual provisioning, flash drives, improved network connectivity and enhanced disaster-recovery options.

A Better View of Microsoft Security?

Microsoft is gearing up to expand its Trustworthy Computing initiative by sharing more information with end users and with other security vendors. The Microsoft Exploitability Index and the Microsoft Active Protections Program (MAPP) will provide new visibility into security vulnerabilities that affect Microsoft products.

The new initiatives come as Microsoft makes its third appearance at the Black Hat security conference in Las Vegas, a conference that has in the past offered up some significant Microsoft vulnerabilities.

“One of the reasons why we’re at Black Hat is to hear feedback and make sure that these programs are as effective as we intend them to be,” Mike Reavey group manager at the Microsoft Security Response Center told InternetNews.com.

My daughter is going into sixth grade, and she’s pretty excited about taking more advanced math and science classes, which she gets from her dad. I need a calculator to figure out a 20-percent tip.
